What are the latest requirements for cosmetic OEM testing and filing?

Product Registration and Filing New Requirements Notification Letter

Dear Valued Customers:

According to the latest "Regulations on the Supervision and Administration of Cosmetics", "Administrative Measures for Cosmetic Registration and Filing", and "Provisions for the Management of Cosmetic Registration and Filing Information", these regulations put forward new requirements for cosmetic registration and filing. Please prepare actively for the following work.

I. The new cosmetic registration and filing information service platform has been launched, effective from 2021 Year 4 Month 1 Day, domestic cosmetic registrants, filers, domestic responsible persons, and cosmetic manufacturers can access the National Medical Products Administration (NMPA) Online Service Hall via the National Integrated Online Government Service Platform ( https://zwfw.nmpa.gov.cn ), and submit relevant information on the cosmetic registration and filing information service platform in accordance with the "Provisions" to apply for registration and filing user accounts; as of 2021 Year 5 Month 1 Day, cosmetic registrants, filers, and domestic responsible persons shall apply for special cosmetic registration or conduct general cosmetic filing through the new registration and filing platform. The original cosmetic administrative licensing and filing information management system will no longer accept applications for special cosmetic registration or general cosmetic filing.

II. 2021 Year 5 Month 1 New product filings after this date must be completed on the new filing and registration platform. Existing old accounts will still require registration of new corporate and individual accounts. Previously filed products can link their data to the new system by binding old accounts through the registered corporate account. By 2022 Year 5 Month 1 Day, submit product execution standards, draft product labels, and fill in product formulas and sales packaging images for domestic general cosmetics.

III. If the requirements for registering an account on the new cosmetic registration and filing platform cannot be met, resulting in the inability to obtain an account, new product development and filing work cannot be completed in the long term.

The following materials are required for registering an account on the new cosmetic registration and filing platform:

1.  Registrant Information Form (including information on the corporate legal person and quality and safety responsible person)

2. Resume, appointment letter, academic qualification certificates, and other documents for the quality and safety responsible person. (Article 32 of the Regulations stipulates: The quality and safety responsible person shall possess professional knowledge related to cosmetic quality and safety, and have 5 years or more of experience in cosmetic production or quality and safety management.)

3. Possess a quality management system suitable for the products applied for registration and filing. (Article 18 of the Regulations)

4. Possess management documents for cosmetic adverse reaction monitoring and evaluation (Article 52 of the Regulations)

5. Possess relevant documents for supervising the production activities of commissioned enterprises. (Article 28 of the Regulations)

6. Possess established and implemented management systems for supplier selection, raw material acceptance, production process and quality control, equipment management, product inspection, and retained samples. (Article 29 of the Regulations).

Among these, the required 3-6 points, after the order is confirmed and the deposit is paid, our company can provide templates and guide your company to complete them.

Additionally: If your company does not have a suitable quality and safety responsible person or cannot meet the registration platform account requirements, our company also offers the following two methods for production and sales:

1.  You can act as an agent for our company's branded products and sell them directly.

2.  Your company possesses a registered trademark and authorizes our company to produce and process the brand. Your company will be the global general distributor for all products manufactured in our factory. (A commitment letter for global general distribution needs to be signed, see attachment for details.)

Brand Market General Distribution Commitment Letter

   In accordance with the "Regulations on the Supervision and Administration of Cosmetics" and relevant laws and regulations, our company solemnly commits that when our company authorizes the XXX brand to Mingyu (Guangdong) Cosmetics Technology Co., Ltd. for production, and acts as the global general distributor for products manufactured by Mingyu (Guangdong) Cosmetics Technology Co., Ltd. for        this brand product. In terms of market operation, we strictly abide by national laws and regulations, operate legally; do not sell counterfeit or inferior products; do not exaggerate illegal publicity; pay taxes according to law; comply with national financial and tax systems; provide good market after-sales service, conscientiously handle consumer complaints, and protect consumer rights according to law. We will also actively assist and cooperate with the work of market supervision and administration departments; for product quality issues arising in the market, if caused by the producer, our company will be responsible for following up and resolving them with the producer. For other issues arising in the market, such as market promotion, taxation, pricing, and after-sales service for distributors, our company shall be solely responsible for resolving them, and they are unrelated to the producer.

If, due to our company's poor management or illegal acts during market operation, negative impacts or economic losses are caused to the producer, Mingyu (Guangdong) Cosmetics Technology Co., Ltd., our company shall bear the corresponding compensation liability.
